Landlord's evidence: "He stated that the Gardai had told him to get rid of the Respondent Tenant. He also asserted that his own business letting out rooms in his home on Airbnb would be harmed by having the Respondent Tenant remain in occupation where the dwelling in question was situated right next to his home and that as such he terminated the tenancy before the summer season." Tenant's evidence: He outlined that the Appellant Landlord threatened and intimidated him and broke windows in the dwelling and asserted that on the 7th May 2015 he was told by the Appellant Landlord to “get out”. He also stated that the Appellant Landlord had a sledge hammer and bolt cutters with him on the day in question and contended that he was told to “put all his stuff in black bags and store them outside” and to “get a taxi and get out”... In respect of the 7th May he stated that the events were traumatic for him as he had nowhere to go and that he had to move all his stuff from the dwelling. He stated that he had to stay in a homeless shelter for a while and then further with a friend."
