Tenant’s evidence: “He said that he felt that the grounds on which the Respondent Landlord sought to terminate the tenancy were entirely spurious that the Respondent Landlord regarded the Tenants as an inconvenience who had to be gotten out and that they were being evicted because they were complaining. He said that he and his wife were extremely aggrieved and distressed by what had happened which had also placed considerable stress on their relationship and cost them greatly both personally and financially.” RTB decision: “The response of the Respondent Landlord once she became aware of the flooding was inadequate given the extent of the flooding (every room in the dwelling) the time of the year (early January) and the composition of the household which included a 2 year old child. The Respondent Landlord was aware that the flooding posed health risks and apart from arranging for the old carpets to be lifted and replaced gave no further assistance to the Applicant Tenant and further added to his distress and that of his family by serving the Notice of Termination on January 21st the day before the carpets were replaced”.
