Landlord's evidence: "She said she received a call from the Tenant’s friend the weekend after she changed the locks but she could not let the Tenant in that weekend as she was working... The Landlord accepted that she had removed the Tenant’s fridge freezer from the dwelling. She stated that it was filthy and unusable and she had left it out the front of the dwelling with the suite of furniture which she said was damaged. She said some people passing by had asked her could they take the items away and she agreed... She stated that she threw out the coffee table because it was broken. Tenant's representative: "She stated that the Tenant knew from the hearing report that she had 60 days from the date of the Determination Order to vacate the Dwelling and was waiting for this time to elapse before moving out... She stated that Tenant was at work on the morning of 22 April 2016 when the locks were changed and her children were at school. The Respondent Tenant said she had been hospitalised since the termination of the tenancy and the stress of it had contributed to her poor health... The Tenant’s two children gave evidence in relation to the effect the termination of the tenancy had on them. They said they had to spend a number of nights at a friend’s house before finding accommodation at a local B&B which they said was very disruptive. The Tenant’s son said he was deprived of the use of his school books and school notes in the weeks coming up to the leaving certificate and he had felt it had effected his performance in his exams."
