Tenant’s evidence: "One of the Respondent Tenants saw an ad for the dwelling for rent on 16 January 2017 with an increased rent of €1900 per month... The Respondent Tenants who have two children together are now living with the mother of one of the Respondents in a four bedroom house in Templeogue". RTB decision: "A landlord or tenant may not terminate a fixed term tenancy unless there has been breach of obligations by the landlord or tenant... The factual matrix presented certainly gave the impression that the Appellant Landlord may have perhaps been hedging her bets in the approach she took and that she may not have in fact actually positively decided to reside in the dwelling"
