Tenant's evidence: "The Appellant Tenant gave evidence that he has 2 children ages 8 and 4 and that this has been extremely inconvenient for his family. He stated that the tenancy commenced back in 2011 and since then he had made a home for his family in the dwelling and formed good friendships with the neighbours. He said it has therefore been extremely upsetting for his wife and in particular the timing of the service of the Notice of Termination in December 2017 so close to Christmas". RTB decision: "The matter which the Tribunal is concerned with is did the Respondent Landlord require the property for her own use at the material time which the Tribunal finds on balance she did not. Consequently the Respondent Landlord unjustly denied the Appellant Tenant the benefit of the tenancy".
