Tenant's evidence: "He said that the Respondent Tenants were allocated emergency accommodation prior to the termination date of the 1st of July 2018 because Wexford County Council said that the dwelling was not fit for human habitation. Second tenant's evidence: "She said that she came back to the dwelling in or about 6.30 p.m. and that her husband the first named Respondent Tenant was to follow to empty out the shed which contained his tools. She said that she arrived at the dwelling and drove into the yard to find that all her possessions which she had left in the hall were now outside at the front of the dwelling. She said that she went to put her key in the door of the dwelling and discovered that the locks had been changed. She said that her friend Rosemarie Murphy and her mother came to the dwelling to assist her and that the Gardai were called." Tenant's witness: "She said that Mr. Egan was verbally aggressive that he said he would not let Ms. Cleary into the dwelling and that he pushed Ms. Cleary out of his way to get to the front door." RTB decision: " The Appellant Landlords had served a valid Notice of Termination in respect of the tenancy in the dwelling with a termination date of the 1st of July 2019. However on the 12th of June 2018 the first named Appellant Landlord Mr. Egan entered the dwelling and changed the locks notwithstanding that he observed a lorry and van outside the dwelling which he said he presumed belonged to the Respondent Tenants."
