Tenant's evidence: "On the 11th April 2018 the first-named Respondent Tenant was informed that the dwelling was still uninhabitable and posed a health hazard that her tenancy was up and the locks were changed on that date by the contractor engaged by the Appellant Landlord." RTB decision: "A landlord is not entitled to take back possession of a dwelling from a tenant in occupation simply because the termination date specified in a notice of termination has passed or is shortly to expire. Further a landlord is not entitled to terminate a tenancy with immediate effect in a situation where repairs have to be carried out... The first-named Respondent Tenant and her child were forced to take up accommodation in a B&B initially and thereafter in a refuge for a significant period of time."
